What is a Septic System Maintenance Contract?

If your property has an aerobic treatment unit (ATU), Texas law requires it to be covered by an ongoing septic maintenance contract.

Our Modern Septic Maintenance Memberships fulfill that requirement — giving you peace of mind that your system is inspected, tested, and reported according to TCEQ regulations.

Each septic maintenance visit includes:

  • Inspection of aerators, pumps, filters, alarms, and disinfection systems
  • Effluent testing and spray field evaluation
  • Reporting to you and your local permitting authority

Qualified Provider

The maintenance contract must be with a licensed maintenance provider (an individual) who meets TCEQ licensure requirements.

The provider must hold required licenses (Installer Class II, or Class C or higher Wastewater Operator) plus approved training and exam.

Contract Content

The maintenance contract must specify: 1) list of covered items, 2) response time for complaints, 3) name of the individual doing the work, 4) frequency of routine maintenance/testing/reporting, 5) responsibility for the disinfection unit.

Ensures clarity for homeowner, provider & permitting authority.

Inspection & Testing Frequency

Provider must inspect components at each visit (aerators, pumps, filters, alarms, disinfection systems). Effluent testing and spray-field evaluation required.

Mechanical systems require more frequent attention.

Reporting to Authority & Owner

Reports must be submitted to both the property owner and the local permitting authority. Minimum frequency: every 4 months.

If electronic monitoring is installed and active, frequency may be reduced to every 6 months.

Electronic Monitoring Option

If system uses an electronic monitor or automatic radio/telephone notification system for failures & disinfection level, then reporting may be every 6 months.

The maintenance provider must ensure monitoring system is functioning.

Identification Tagging

At the beginning of a contract, a tag or other identification must be installed on the system; the tag must be punched/marked at each service visit (including responses to complaints) so owner has record of visits.

Helps maintain service documentation and compliance.

Chlorine/Disinfection Requirements

If disinfection of secondarily treated wastewater effluent is required and chlorine tablets are used: must use calcium hypochlorite tablets certified for wastewater disinfection by EPA — not swimming-pool chlorine tablets.

Using incorrect tablets could result in inadequate disinfection or explosion risk.

Pumping Conventional Systems

For conventional septic tanks, it’s recommended to pump every 3–5 years to prevent treatment process “short-circuiting”.

For aerobic treatment units, pumping depends on sludge depth & manufacturer’s guidance.

Statutory/Rule Authority

Maintenance requirements are governed by Texas Health & Safety Code § 366.0515 and rule 30 TAC §285.7.

Local permitting authorities may adopt more stringent requirements; always check local rules.
